7. Links to and from other websites

7.1 To provide increased value to our users, we may provide links to other websites or resources for you to access at your sole discretion. You acknowledge and agree that, as you have chosen to enter the linked website we are not responsible for the availability of such external sites or resources, and do not review or endorse and are not responsible or liable, directly or indirectly, for (i) the privacy practices of such websites, (ii) the content of such websites, including (without limitation) any advertising, content, products, goods or other materials or services on or available from such websites or resources or (iii) the use to which others make of these websites or resources, nor for any damage, loss or offence caused or alleged to be caused by, or in connection with, the use of or reliance on any such advertising, content, products, goods or other materials or services available on such external websites or resources.

8. Indemnity

You agree fully to indemnify, defend and hold us, and our officers, directors, employees, agents and suppliers, harmless immediately on demand, from and against all claims, liability, damages, losses, costs and expenses, including reasonable legal fees, arising out of any breach of the conditions by you or any other liabilities arising out of your use of this website, or the use by any other person accessing the website using your shopping account and/or your personal information.

9. Limitation of liability

9.1 We take all reasonable steps to ensure that the information on this website is correct. However, we do not guarantee the correctness or completeness of material on this website.
9.2 The website is provided on an "as is" and "as available" basis without any representation or endorsement made and we make no warranties of any kind, whether express or implied, in relation to the website, or any transaction that may be conducted on or through the website including but not limited to, implied warranties of non-infringement, compatibility, security, accuracy, conditions of completeness, or any implied warranty arising from course of dealing or usage or trade.
9.3 We make no warranty that the website will meet your requirements or will be uninterrupted, timely or error-free, that defects will be corrected, or that the site or the server that makes it available are free of viruses or bugs or represents the full functionality, accuracy, and reliability of the website. We will not be responsible or liable to you for any loss of content or material uploaded or transmitted through the website.
9.4 To the fullest extent permissible under applicable law, we disclaim any and all warranties of any kind, whether express or implied, in relation to the goods. This does not affect your statutory rights as a consumer, nor does it affect your Contract Cancellation Rights.
9.5 We reserve the right to modify or withdraw, temporarily or permanently, this website (or any part thereof) with or without notice to you and you confirm that we shall not be liable to you or any third party for any modification to or withdrawal of the website.
9.6 We will not be liable, in contract, tort (including, without limitation, negligence), pre-contract or other representations (other than fraudulent or negligent misrepresentations) or otherwise out of or in connection with the conditions for:

  • any economic losses (including without limitation loss of revenues, profits, contracts, business or anticipated savings); or
  • any loss of goodwill or reputation; or
  • any special or indirect losses suffered or incurred by that party arising out of or in connection with the provisions of any matter under the conditions.

9.7 Any advice or recommendation given by us is followed or acted upon entirely at your own risk.
9.8 Nothing in the conditions shall exclude or limit our liability for death or personal injury resulting from our negligence or that of our servants, agents or employees.

10. Law and jurisdiction

These conditions are governed by and construed in accordance with the laws of England and you agree that the English courts will have exclusive jurisdiction for any dispute under this agreement.
The laws of your country may be different from English law and there may be additional legal requirements for you to use our website or services. You must comply with all applicable local and international laws, statutes, ordinances and regulations regarding your use of our website and services.
We cannot monitor the laws of every country and it is your responsibility to ensure that your use of our website and services is legal.

11. Orders

We will take all reasonable care, in so far as it is in our power to do so, to keep the details of your order and payment secure, but in the absence of negligence on our part we cannot be held liable for any loss you may suffer if a third party procures unauthorised access to any data you provide when accessing or ordering from the website.

Contract creation and electronic contracting

The technical steps required to create the contract between you and us are as follows:

  • You place the order for your products on the website by pressing the confirm order button at the end of the checkout process. You will be guided through the process of placing an order by a series of simple instructions on the website.
  • We will send you an Order Confirmation email to acknowledge your offer. Your offer is considered accepted by us only when we despatch the goods and send you a Despatch Confirmation email. Any goods on the same order not despatched and confirmed in a Despatch Confirmation email do not form part of that contract.

We reserve the right to reject any offer at our discretion at any time prior to acceptance. Rejected orders will be refunded in full or not charged. Non-acceptance of an order may result from one of the following:

  • The goods you ordered being unavailable.
  • Our inability to obtain authorisation for your payment.
  • The identification of a pricing or product description error.
  • You not meeting the eligibility to order criteria set out in our Terms & Conditions.

The contract will be concluded in English.

12. Descriptions and product information

12.1 All goods purchased are sold subject to their product descriptions which set out additional Specific Conditions related to those goods including, without limitation, terms and conditions concerning estimated delivery dates and times, warranties, after-sales service and guarantees.
12.2 We will take all reasonable care to ensure that all details, descriptions and prices of goods appearing on the website are correct at the time when the relevant information was entered onto the system. Although we aim to keep the website as up to date as possible, the information including product descriptions appearing on this website at a particular time may not always reflect the position exactly at the moment you place an order. We cannot confirm the price of a product until your order is accepted in accordance with our order acceptance policy.
12.3 Please note that packaging may vary from that shown on the website.
12.4 Please note that the weights, dimensions and capacities shown on the website are approximate only.
12.5 All photographs, illustrations and drawings are for illustrative purposes only, and may not exactly match the product itself.
12.6 Whilst we try to display the colours of our products accurately on the website, the actual colours you see will depend on your monitor and we cannot guarantee that your monitor's display of any colour will accurately reflect the colour of the product on delivery.
12.7 All products displayed on this website are available only whilst stocks last.

13. Prices

All prices are displayed in pounds Sterling (£) unless clearly indicated otherwise. We are not currently VAT registered so no VAT will be chargeable. All prices are subject to change without prior notice.

14. Age restricted products

The purchase of certain goods and services made available on the website are subject to age requirements specified by law. We are not permitted by law to supply these products or services to individuals who do not satisfy these age requirements and, if you are underage, you must not attempt to order these products or services through the website.
In particular, please note that age restrictions apply in the UK to the purchase of the products and services listed below. By placing an order for any of the following products or services you confirm that you (and, if different, the recipient of the product and/or service) satisfy the age requirements necessary to buy that product or service:

  • Knives (including sheath knives, all kitchen/cutlery knives) or bladed articles. Knives and bladed items can only be purchased by, and for, individuals aged 18 and over.
  • Videos and DVDs. Videos and DVDs can only be purchased by, and for, individuals who satisfy the British Board of Film Classification or other age classification criteria applicable to the relevant video or DVD. Videos and DVDs can only be purchased by, and for, individuals who satisfy these age classification criteria.

15. Delivery

15.1 Whilst we will use our best endeavours to deliver the goods promptly, any time or date for delivery given by us is given in good faith and is an estimate only.
15.2 We shall not be liable for the consequences of any delay howsoever caused.
15.3 In the event of any goods delivered by us being damaged in transit, deficient of items shown on the delivery note or failing to match the items ordered by you, then such details must be notified by you to us within seven working days of receipt. If we receive no such notification, the purchaser will be deemed to have accepted the goods as satisfactory.

16. The Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013

This legislation offers you the following cancellation rights when you buy online or by phone:

  • You are entitled to cancel your contract if you so wish, provided that you exercise your right no longer than 14 days after the day on which you receive the goods or services.
  • Your right to return products does not apply to goods made to your specification, that have been clearly personalised or which by reason of their nature cannot be returned or are liable to deteriorate or expire rapidly.
  • If you wish to exercise your right of cancellation, you are obliged to retain possession of the goods and take reasonable care of them. The goods must be in an ‘as new’ condition and returned in the original, undamaged packaging, along with any accessories and free gifts received with them.
  • To exercise the right to cancel, you must inform us of your decision to cancel your contract by a clear statement, including details of your name, geographical address, details of the order you wish to cancel and, where available, your phone number and email address. You can do this via the contact form found at www.compassandcampfire.co.uk/index.php?route=information/contact or write to us at the address shown on that web page or contact us via our returns page found at www.compassandcampfire.co.uk/index.php?route=account/return/insert.
  • If you decide to cancel, you should return the goods to us at your cost within 14 days of such cancellation and we will reimburse to you (by the method used to pay for the original transaction) the amount in relation to goods to which cancellation rights apply. This includes the cost of delivery (except for the supplementary costs arising if you choose a type of delivery other than our standard and least expensive method of delivery).
  • Return postage will only be refunded if the goods are faulty. If return postage is refunded, it may be provided to you via a different method than that used to pay for the original transaction.
  • We may make a deduction from the reimbursement for loss in value of any goods supplied, if the loss is the result of unnecessary handling by you. Please see our Returns page found at www.compassandcampfire.co.uk/index.php?route=account/return/insert for further details.

17. Faulty goods

17.1 If the goods are found to be faulty, please notify us via the returns form found at www.compassandcampfire.co.uk/index.php?route=account/return/insert or in writing providing details of the problem. We will deal with the matter in accordance with your legal rights.
17.2 All goods are covered by a manufacturer’s warranty against faulty workmanship and materials, subject to the terms and conditions of that warranty.
17.3 The manufacturer’s warranty is provided in addition to the rights that the law says you have as a consumer and accordingly, your statutory rights are not affected.
17.4 If an exchange is necessary, this will be arranged without unreasonable delay and without charge. Replacement goods will not be dispatched until the original goods have been received by us and checked.
17.5 The cost of returning goods to us is your responsibility, however on inspection we will refund your reasonable postage costs, providing that the goods are found to be faulty. If the goods are not faulty, we will return them to you, however you will be required to cover our reasonable postage costs.
17.6 If an item is no longer available, we may offer an alternative. However our liability will be to replace the faulty goods only and we are unable to guarantee an exact match. In this instance you will have the option of a refund.
17.7 Where we replace faulty goods you are responsible for their disposal if they have not previously been returned to us.

18. Product reviews

18.1 Customer reviews shown on our website in no way represent the views of Compass and Campfire.
18.2 We reserve the right to remove or refuse to post any customer review we consider inappropriate.

19. Gift certificates

19.1 Gift certificates can be redeemed in multiple purchases until the balance is used. Gift certificates will expire on the date shown. After their expiry date, gift certificates will be treated as void and are non-exchangeable and non-refundable.
19.2 Gift certificates cannot be returned or refunded or redeemed for cash.
19.3 We reserve the right to refuse to accept a gift certificate which we deem to have been tampered with, duplicated, damaged or which otherwise is suspected to be affected from fraud.

20. Promotional discounts

20.1 Voucher code reductions and other promotional discounts are taken from the 'Sub Total' amount in the Shopping Cart. Valid dates will be included where the voucher code is displayed.
20.2 Voucher code reductions cannot be used in conjunction with any other offer.
